Definitions
"Tany," "we," "us" — Tany Tech Inc., a Canadian corporation. "Platform" — the Tany software you access through tany.ca, app.tany.ca, console.tany.ca, and any mobile app built on our infrastructure. "Merchant" — a shop, café, or retailer that uses Tany to run their mobile ordering. "Customer," "you" — a person using a Merchant's branded app to place orders.
Using a Tany-powered app
When you place an order in a branded app:
- The Merchant is your seller. They set prices, prepare your order, and issue any refunds.
- Payment goes to the Merchant through Square (their payment processor). Tany never holds your money.
- The order details — items, modifiers, allergens — come from the Merchant's Square catalog. We display what they publish.
- Loyalty rewards and gift cards are operated by the Merchant via Square. Balances and redemption rules are theirs.
- Pickup, in-store, or delivery instructions follow the Merchant's policies. Issues with a specific order are best handled by contacting the Merchant directly.
Service fees
Tany may add a small service fee per mobile order ($0.30 CAD). The fee appears as a separate line item at checkout — you'll see it before you pay. This fee supports the platform that powers the app.
Your account
You're responsible for keeping your phone number current and not letting others use your account. We use phone-based one-time codes — no passwords to leak. You can delete your account from Account → Delete account at any time. After deletion, past order records may be retained for the periods required by Canadian tax law (typically 6 years), but your personal information is removed.
Text messages
By providing your mobile number and tapping Continue on the sign-in screen, you agree to receive automated text messages from Tany, sent on behalf of the shop where you order, at that number. These include one-time sign-in codes and order updates — for example, a notification when your order is ready for pickup — and, where you've separately opted in, promotions from the shop. Message frequency varies with your activity (for example, one code per sign-in and one update per order), and message and data rates may apply. Reply STOP at any time to stop all texts from this number, or HELP for help ([email protected]); reply START to resume. If you opt out, we can no longer text you sign-in codes or order-ready alerts, so those SMS features stop working — you can still sign in and get order updates in the app or by email. Consenting to promotional texts is never a condition of any purchase. See our Privacy Policy for how we handle your number.
The agreement
By signing up for Tany you agree to these terms. We provide the platform; you operate your shop. Both of us follow the rules below.
What Tany provides
A multi-tenant mobile ordering platform: branded iOS + Android apps published under our Apple Developer and Google Play accounts, an operator dashboard, push notifications, loyalty + gift cards, customer data storage, and integration with your Square POS.
Pricing
Standard plan: $99 CAD per month subscription + $0.30 CAD per order processed via the platform. Billed monthly via Stripe card-on-file. The customer-facing service fee shown to your customers is $0.30 by default; you may absorb it instead from your operator dashboard. Applicable Canadian taxes are included in the per-order fee and added to the subscription on your invoice. See pricing on the home page for current pricing.
Billing start
We do not offer a self-serve free trial. New Merchants apply through /apply and complete a setup call with Tany before activation. Billing begins on the day your branded app is approved for App Store / Play Store distribution (typically within one week of the setup call). Per-order fees begin accruing when your customer-facing app accepts its first paid order.
Your data
You own your customer data. If you cancel, we export it as CSV and delete our copy within 30 days. We never sell, share, or train on your data.
Cancellation
Month-to-month. 30 days notice required. We'll remove your app from the App Store and Play Store at the end of your notice period.
Acceptable use
You won't use Tany to sell illegal goods, run unlicensed businesses, send spam, or violate Apple's or Google's app store policies. If you do, we reserve the right to suspend service.
Data roles and responsibilities
For the personal information of customers who order through a branded app, the Merchant is the data controller and Tany acts as the Merchant's data processor — we collect and process that data on the Merchant's behalf under these terms, which serve as the data-processing agreement between us. Tany is the controller only for the limited data needed to run the platform itself (Merchant account, billing, and tany.ca visitors).
The Merchant is responsible for: having a lawful basis to collect customer data, displaying an accurate privacy policy, honouring customer data requests (access, correction, deletion) within the timeframes required by law, and complying with the privacy, marketing, and consumer-protection laws of the places they operate. Tany is responsible for: maintaining the platform and its security, binding our sub-processors (e.g. Square, Supabase, Twilio, Stripe, Expo) to handle data lawfully, and providing the consent and privacy tooling described in our Privacy Policy. Each party indemnifies the other for losses arising from its own failure to meet these responsibilities or to comply with applicable law.
Liability
Tany is provided "as is." We don't guarantee uninterrupted service, but we'll work hard to keep it running. For Merchants, our liability is capped at the fees you paid in the previous 12 months. For Customers, our liability is capped at the amount you paid Tany directly (typically just service fees). We're not liable for indirect, consequential, or punitive damages. Nothing here limits liability that can't be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Tany and its operators from claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the service, your violation of these terms, your violation of any law or third-party right, or — for Merchants — your operation of your business and your handling of customer data as the data controller.
Events beyond our control
We're not liable for delays or failures caused by events beyond our reasonable control — including platform or internet outages, payment-processor or Square downtime, supplier failures, natural disasters, or government actions.
Changes to these terms
We post material changes to this page at least 30 days before they take effect. Pricing changes grandfather Merchants for 6 months on the previous plan.
Governing law
These terms are governed by the laws of Ontario, Canada. Courts in Toronto, Ontario have exclusive jurisdiction over any dispute.
Resolving disputes
If a dispute comes up, contact us first — most issues are resolved quickly and informally. If we can't resolve it within 30 days, it goes to the courts of Toronto, Ontario as set out above. Nothing here stops either of us from seeking urgent injunctive relief, or you from filing a complaint with a privacy or consumer-protection regulator.
